gem. Art. 13 Datenschutzgrundverordnung (DSGVO)

Falls nicht ausdrücklich schriftlich etwas anderes vereinbart ist, gelten die der Firma Weiler Abrasives GmbH im Zusammenhang mit der Bestellung mitgeteilten/unterbreiteten Informationen als nicht vertraulich, es sei denn, die Vertraulichkeit ist offenkundig.

Die Firma Weiler Abrasives GmbH weist und informiert gemäß Art. 13 DSGVO darauf hin, dass die Firma Weiler Abrasives GmbH (auch personenbezogene Daten) aus dem jeweiligen Vertragsverhältnis zum Zwecke der Datenverarbeitung speichert und das Recht vorbehält, diese Daten, soweit für die Vertragserfüllung erforderlich, Dritten zu übermitteln. Verarbeitungszweck und Rechtsgrundlage:

Die Belieferung setzt vertraglich gegebenenfalls voraus, dass der Besteller personenbezogene Daten (nachfolgend: „Daten“) übermittelt. Die Firma Weiler Abrasives GmbH verarbeitet diese Daten zum Zwecke des Vertragsabschlusses und zum Zwecke der Vertragserfüllung (einschließlich der Rechtsverfolgung und des Forderungseinzuges) auf Grundlage der datenschutzrechtlichen Bestimmungen, insbesondere Art. 6 Abs. 1 b DSGVO. Die Firma Weiler Abrasives GmbH verarbeitet die Daten darüber hinaus auf Grundlage der datenschutzrechtlichen Bestimmungen zur Wahrung der berechtigten Interessen, insbesondere Art. 6 Abs. 1 f DSGVO. Die Firma Weiler Abrasives GmbH verarbeitet nachfolgende Kategorien von Daten: Stammdaten (wie z. B. Firma, gegebenenfalls Ansprechpartner, Adresse), Kommunikationsdaten, Vertragsdaten, Forderungsdaten, gegebenenfalls Zahlungs- und Verzugsinformationen.

Empfänger und Drittempfänger:

Die Daten dürfen unter Beachtung der einschlägigen Regelungen an Auskunfteien zu Vermeidung von Forderungsausfällen bei Dritten oder der Firma Weiler Abrasives GmbH übermittelt werden, z. B. zur Erhebung von Wahrscheinlichkeitswerten für einen Forderungsausfall oder zur Übermittlung unstreitiger oder rechtskräftig festgestellter Forderungen, mit denen sich der Besteller in Verzug befindet. Die Auskunfteien speichern die an sie übermittelten Daten auch, um sie den ihnen angeschlossenen Vertragspartnern im Rahmen der Beurteilung des Forderungsausfallrisikos bereitstellen zu können. Eine solche Bereitstellung der Daten erfolgt jedoch nur, wenn die an der Auskunftei angeschlossenen Vertragspartner ein berechtigtes Interesse an der Übermittlung der Daten aufweisen können. Die Auskunftei kann zum Zwecke der Schuldnerermittlung Adressdaten mitteilen. Der Besteller kann von der Auskunftei Informationen zu über ihn gespeicherten Daten erhalten. Bei einem Forderungseinzug können Daten an folgende Kategorien von Empfängern übermittelt werden, sofern dies zum Einzug der Forderung erforderlich ist: Abtretungsempfänger, Auskunfteien, Inkassounternehmen, Drittschuldner, Einwohnermeldeämter, Gerichte, Gerichtsvollzieher, Rechtsanwälte.

Produktinformationen:

Die Firma Weiler Abrasives GmbH nutzt auf Grundlage der datenschutzrechtlichen Bestimmungen, insbesondere Art. 6 Abs. 1 f DSGVO Daten, um dem Besteller gegebenenfalls auf postalischem oder – unter Beachtung von § 7 Abs. 3 UWG – elektronischem Wege Informationen über unsere sonstigen Leistungen zukommen zu lassen.

Datenspeicherungsdauer:

Die Firma Weiler Abrasives GmbH löscht die Daten unverzüglich, wenn diese hierzu verpflichtet ist. insbesondere wenn diese die Daten für die Zwecke, für die sie erhoben sind, nicht mehr benötigen und keine Aufbewahrungspflichten entgegenstehen. Unabhängig davon erfolgt alle drei Jahre eine Überprüfung, ob eine Löschung der Daten möglich ist.

Widerspruchsrechte:

Der Besteller kann der Datenverarbeitung zu dem unter „Produktinformationen“ genannten Zweck jederzeit gegenüber der Firma Weiler Abrasives GmbH widersprechen. Der betroffenen Person steht unabhängig davon ein Widerspruchsrecht nach Art. 13 Abs. 2 b bzw. Art. 14 Abs. 2 c i. V. m. Art. 21 DSGVO gegen die Verarbeitung nach Art. 6 Abs. 1 f DSGVO zu.

Sonstige Rechte der betroffenen Person:

Der betroffenen Person stehen bei Vorliegen der gesetzlichen Regelungen (insbesondere DSGVO, Bundesdatenschutzgesetz) folgende Rechte zu: Recht auf Auskunft, Berichtigung, Löschung, Einschränkung der Verarbeitung und auf Datenübertragbarkeit.

Beschwerderecht bei der Aufsichtsbehörde:

Zudem kann sich die betroffene Person bei der Aufsichtsbehörde gemäß Art. 77 DSGVO beschweren, wenn diese der Ansicht ist, dass die Verarbeitung der personenbezogenen Daten nicht rechtmäßig erfolgt.
